Terms of Use

1. Acceptance of Terms

By accessing or using FlatMatchr NZ ("the Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not use the Platform. These Terms apply to all visitors, registered users, and anyone who accesses or uses the Platform in any way.

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting a notice on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the updated Terms.

2. Service Description

FlatMatchr NZ is an online platform that connects people seeking rental accommodation in New Zealand with property owners and existing tenants offering rooms or flats for rent. We act as an intermediary only and are not party to any rental agreement entered into between users.

The Platform is provided free of charge to renters. We do not verify the accuracy of all listings or the identity of all users, and we encourage all users to exercise due diligence before entering into any rental arrangement. Always view a property in person before paying a bond or signing a tenancy agreement.

3. User Accounts

To post listings or contact other users, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised use of your account

You must provide accurate, current, and complete information when creating your account and keep this information up to date. You must be at least 18 years old to create an account or post listings on the Platform.

4. Listing Rules

All listings posted on FlatMatchr NZ must accurately describe the property or flatmate profile. Listings must comply with:

• The Residential Tenancies Act 1986
• The Human Rights Act 1993 (no discriminatory listings based on sex, race, religion, disability, sexual orientation, or other protected grounds)
• All other applicable New Zealand laws

Listings must not contain false or misleading information, inappropriate content, contact details embedded in photos, or pricing that does not match what is actually on offer. We reserve the right to remove any listing that violates these rules without notice.

5. Prohibited Conduct

You must not use the Platform to:

• Post fraudulent, misleading, or deceptive content
• Harass, threaten, intimidate, or stalk other users
• Collect or harvest user data without authorisation
• Attempt to circumvent security measures or access accounts that are not your own
• Post spam, chain letters, or unsolicited commercial messages
• Impersonate another person or organisation
• Use the Platform for any illegal activity, including but not limited to fraud or unlawful discrimination
• Scrape, crawl, or systematically download content from the Platform

We reserve the right to suspend or terminate accounts that violate these prohibitions. Serious violations may be reported to New Zealand Police or relevant authorities.

6. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that:

• The Platform will be uninterrupted or error-free
• Listings or profiles are accurate, complete, or up to date
• The Platform is free from viruses or other harmful components

User-generated content is the sole responsibility of the user who created it. We are not responsible for the accuracy, completeness, or legality of any listing or profile posted by users.

7. Limitation of Liability

To the maximum extent permitted by New Zealand law, FlatMatchr NZ and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.

Our total liability for any claim arising from or related to these Terms or the Platform shall not exceed NZD $100. Nothing in these Terms limits liability for death, personal injury caused by negligence, or fraudulent misrepresentation.

8. Intellectual Property

The Platform and its original content, features, and functionality are owned by FlatMatchr NZ and are protected by New Zealand and international intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Platform without our express written permission.

By posting content on the Platform, you grant FlatMatchr NZ a non-exclusive, royalty-free licence to use, display, and distribute that content on the Platform and in promotional materials related to the Platform.

9. Termination

We may terminate or suspend your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may delete your account at any time via your account settings.

Upon termination, your right to use the Platform ceases immediately. Sections of these Terms that by their nature should survive termination (including liability, disclaimers, and governing law) will continue to apply.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of New Zealand. You agree to submit to the exclusive jurisdiction of the New Zealand courts for any dispute arising from these Terms or your use of the Platform.

Disputes relating to rental agreements entered into via the Platform are subject to the Residential Tenancies Act 1986 and the jurisdiction of the Tenancy Tribunal, which provides a free and accessible dispute resolution process for New Zealand tenants and landlords.
